Nineteen employees working for MTN as radio engineers used company cars supplied by MTN with petrol cards. The cars could also be used for personal use up to a certain limit. In December 2014 MTN scrapped the use of company vehicles and informed the employees on 9 December 2014, effective 1 April 2015.
On 26 January 2015 the employees referred an unfair labour practice dispute relating to the provision of benefits to the CCMA in terms of s 186(2)(a) of the LRA.
As that dispute had not been resolved the employees were granted an interdict against MTN to prevent MTM from implementing its decision pending the outcome of the dispute lodged with the CCMA.
