Woolworths (Pty) Ltd v CCMA (DA7/2013) [2015] ZALCD 17 (17 March 2015) per Dlodlo AJA.

Three cashiers at the Hillcrest store in Durban were dismissed for dishonesty because of a shortfall in their cash float and thereby breaching the ‘till discrepancy policy’.  The dismissals were upheld by the CCMA.  The Labour Court reviewed and set aside the award after holding that the award was unreasonable.  The Labour Appeal Court overturned the judgment of the Labour Court and confirmed the fairness of the dismissals.   It was confirmed that the award must be ‘assessed in light of the totality of the evidence presented at the arbitration’.
