Numsa v Videx Wire Products (Pty) Ltd (JR1298/12) [2015] ZALCJHB 367 ; (2016) ILJ 171 (28 October 2015) per Steenkamp J.
The Labour Court refused the trade union’s review application and upheld the CCMA commissioner’s award. The commissioner held that the demands in terms of the Main Agreement governing them constituted demands for remuneration and/or productivity bargaining and may only be negotiated inside the Bargaining Council. Any strike over those demands would not be protected.
