The Labour Court reviewed and set aside as incorrect a jurisdictional ruling and remitted the matter to the CCMA. The applicant was appointed as director of the Centre after being ‘head hunted’ by the chairperson of the Board of Trustees. Later the applicant realised that he was required to be an admitted attorney or advocate. He informed the chairperson who ‘brushed it aside and stated that the matter was going to be addressed by a member of the Board and the instruction was to amend the Deed of Trust by removing the requirement from the Deed of Trust’.
The applicant was summoned to an impromptu meeting of the Board where the chairperson questioned his academic qualifications. The applicant was shocked and felt utterly betrayed and resigned.
