Tsietsi v City of Matlosana Local Municipality (J404/15) [2015] ZALCJHB 92 (13 March 2015) per Rabkin-Naicker J.

After the employer was placed under administration the applicant received a letter on 9 February 2015 from the administrator requiring him to show cause why he should not be placed on precautionary suspension pending the outcome of an investigation into various allegations.  Having failed to respond he was suspended.  In the application to the Labour Court disputing the suspension the applicant referred to regulation 6 of the Local Government: Disciplinary Regulations for Senior Managers.  After considering the case law the Labour Court declined to grant any relief and refused the application with costs.
