In the latest issue of the Industrial Law journal [subscription required] published in the United Kingdom there are number of interesting commentaries, including one by Frederic Reynold Qc Bad Behaviour and the Implied Term of Mutual Trust and Confidence: Is There a Problem? (2015) Ind Law J 44: 262-269.  Mark Freedland has described the implied term as ‘undoubtedly the most powerful engine of movement in the modern law of the employment contract’, and Simon Deakin described it as ‘assuming a central position in the law of the contract of employment’.
