After more than 32 months of waiting the Free Market Foundation (FMF) had announced that the matter has been set down for hearing from 9-12 November 2015 in North Gauteng High Court in Pretoria.   Entrepreneur and businessman, Herman Mashaba, who is the spokesperson for the FMF challenge said, “I cannot wait to hear from the Minister of Labour, in an open court of law, why she supports this piece of legislation.  She owes an explanation to the 8.7 m unemployed and struggling small businesses who have been direct casualties”.  He continued, “The Minister is in the strange position of having to explain why she does not want the right to think about what she does.  Apparently she does not want to think about the devastating impact of extending agreements [to] employers and employees struggling to survive.  The FMF’s case is in support of the Minister’s freedom to decide for herself what she does.  We can’t wait to hear why she does not want this right”.
