In the latest issue of the Industrial Law journal [subscription required] published in the United Kingdom there are number of interesting articles, including one by Guy Davidov and Edo Eshet Intermediate Approaches to Unfair Dismissal Protection (2015) Ind Law J 44: 167-193  in which intermediate solutions to the protection of employees facing dismissal are considered.  These include a:

  • flexicurity system based on broader security provided by the State;
  • default (rather than mandatory) job security rule;
  • prohibition on ‘bad faith’ dismissals; and
  • system based on ‘rich’ procedural guarantees to ensure just cause.
