Business Unity South Africa (Busa) v Minister of Higher Education and Training (JR1110/13) [2015] ZALCJHB 294 (7 August 2015) per Coetzee AJ.

After granting two condonation applications the Labour Court confirmed that it had jurisdiction and then granted the application and declared that regulations 3(12) and 4(4) of the Sector Education and Training Authorities (SETAs) Grant Regulations Regarding Monies Received by a SETA and Related Matters promulgated in terms of s 36 of the Skills Development Act 97 of 1998 in Government Notice R.990 of 3 December 2012 were invalid and set them aside.  But the order was suspended until 31 March 2016 to allow the Minister time to correct the impugned regulations.
