The Labour Court held that the male applicant has been ‘unfairly’ discriminated against on the grounds of his gender and ordered that he be appointed to the post of Senior Manager: Risk and Compliance Audit and compensated as from 11 March 2011 at the higher rate of remuneration.  It was held that the employment equity measures did not comply with the necessary constitutional and statutory requirements.
